Below is the contractual document that will govern the contracting of products through the website www.shobriana.com, owned by B&L JEWELRY LLC (hereinafter the provider). Acceptance of this document implies that the user:

OBJECT OF THE CONTRACT
The purpose of this contract is to regulate the contractual relationship of sale between the provider and the user at the moment when he accepts during the online contracting process the corresponding box.
The contractual relationship of sale involves the delivery, in exchange for a certain price and publicly exposed through the website, of a specific product or service.
CONTRACTING PROCEDURE

The user, in order to access the services offered by the provider, must register through the website by creating a user account. For this, the user must freely and voluntarily provide the personal data that will be required.
The user will select a username and password, committing to make diligent use of them and not making them available to third parties, as well as to notify the provider of the loss or theft of them or of possible access by an unauthorized third party, so that it proceeds to immediate blocking.
Once the user account has been created, it is informed that in accordance with the requirements of article 27 of Law 34/2002, on Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps:
In order to complete the purchase process, the customer must register on the web.
When registering first, the user is given several fields with identifying data to fill in:

On the same page is the shipping address and below the different types of delivery made by the web allowing to leave some additional comment.
A check also appears to confirm that the conditions of use and general contracting conditions have been read.
Next, the payment methods appear, which are not unlocked until the user has not clicked on the terms of use and general contracting conditions.
In any case, the provider's contracting platform will confirm and inform the user, once the contracting procedure is completed, via email, regarding all the characteristics, price, forms of transport, date of contracting and estimate of delivery of the product or contracted service.
FORM OF PAYMENT
The provider puts at your service different means of payment. The buyer can choose between the following modalities to make the payment of his order:

DELIVERY OF ORDERS
The provider sends its products through DHL or SEUR courier companies. In this case your data will be transferred because they are necessary for the provision of the service, and only for the purpose of serving you the product previously purchased on our website.

The delivery of the orders will be made at the address freely designated by the user. The provider does not assume any responsibility when the delivery of the product or service does not take place because the data provided by the user is false, inaccurate or incomplete.
Delivery term
The delivery of orders will be specified in each order, and in no case exceeds 7 business days.
However, the provider informs that exceptionally this period may be longer than the one specified in the order, due to circumstances of force majeure. From this end the user will be notified.
OFFER VALIDITY PRICE AND DEADLINE
The prices indicated for each product include the Value Added Tax (VAT) or other taxes that may be applicable and, in any case, will be expressed in the Euro currency. Such expenses, unless expressly stated otherwise, do not include shipping, handling, wrapping, shipping insurance or any other additional services and annexes to the product or service purchased.
The prices applicable to each product will be those published on the website. The customer assumes that the economic valuation of some of the products may vary in real time. In any case, this fact will always be previously communicated to the users.
Any payment made to the provider will result in the issuance of an invoice in the name of the registered user. Said invoice will be automatically sent to the email address provided by the user, as well as sent together with the product purchased.

RETURNS AND CHANGES
The order will be sent once we have confirmed that the selected item is available and that the payment has been approved. Once the order is placed, it is shipped the next business day and takes 24-72 hours to arrive
National holidays in Spain and in the Community of Madrid, can cause changes in deliveries. Orders will be prepared the next business days.
Delivery
On the purchase form, the customer will be asked for a shipping address within normal business hours. B&L Jewelry LLC is not responsible for errors caused during delivery or if the address indicated by the customer is not compliant or has omitted data necessary for delivery.
Returns & Exchanges
Exchanges
The exchange of an item is possible only for another of the same amount or higher, paying the price difference, otherwise they will receive a credit for their next purchases. B&L Jewelry LLC must be notified within 14 days of receipt of the item. The amount of purchases is not refunded unless the product is damaged.
Each of our items are unique and different since they are all handmade, so each piece will have imperfections.

Returns of Defective or Damaged Products
In the event that the item is damaged or defective, the customer must contact B&L Jewelry LLC for the next 72 hours after receiving the order through info@shopbriana.com
B&L Jewerly LLC will be responsible for all the expenses that come with the collection and subsequent delivery of the product, as long as it is approved by our Quality Department that the item was damaged.
The replacement of the damaged product will be made as soon as possible, within 20 days from the date on which B&L Jewelry LLC has sent an email to the customer with the confirmation of replacement of the item.

ORDER DELIVERY
In the event that it is not possible to deliver the order in two attempts, the product will be returned to our facilities, without the possibility of a refund. If you request a second delivery, you will be responsible for the shipping expenses.
RIGHT OF WITHDRAWAL AND RETURN
This clause will be applicable to the final consumer considered as such in the current regulations on consumers and users, not being valid for customers who are companies.
The current regulations, in this case Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws provides that the user will have a period of fourteen calendar days from the date of receipt of the product to exercise its right of withdrawal, by sending an email to info@shopbriana.com, the parties having to reciprocally restore the benefits in accordance with the provisions of articles 1,303 and 1,308 of the Civil Code.
The user must return the product within 14 calendar days following the one in which he communicated the withdrawal. In any case, unless the return is made due to defects in the product, the expenses related to the return shipment will be borne by the user. This return will be sent to the address we will provide in each case.
The item must be in perfect condition and with its original packaging. Items that have been sent incomplete will not be accepted. In no case will the provider be responsible for any damages or losses that may occur in the course of a return by the customer.
The provider undertakes, exercising the right of withdrawal by the user within the legally established period and once the product is returned, you’ll be automatically refunded in your original payment method.
However, there are a number of exceptions to the right of withdrawal that are included in article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.
Service that has been fully executed or whose execution has already begun as long as the consumer has previously given his consent and acknowledged being aware of its production.
Goods or services whose price depends on fluctuations in the financial market that the employer cannot control and that may occur during the withdrawal period.
Custom goods or services.
Goods that can deteriorate or expire quickly.
Sealed goods that have been unsealed.
Goods by their nature can be mixed with others in an inseparable way without distinction.
Alcoholic beverages whose price has been agreed at the time of entering into the sales contract and cannot be delivered before 30 days, and whose real value depends on market fluctuations that the employer cannot control.
When the consumer has requested an urgent repair or maintenance operation, if the employer provides additional services to those specifically requested by the consumer or supplies goods other than the spare parts necessarily used to carry out maintenance or repair operations, the right of withdrawal must be applied to such services or additional goods.
Daily press, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.
Contracts concluded through public auctions.
Accommodation services for purposes other than housing, transportation of goods, rental of vehicles, food or services related to leisure activities, if the contracts provide for a specific date or period of execution.
Digital content that is not provided on a material support when the execution has begun with the express prior consent of the consumer.
APPLICABLE GUARANTEES
All products offered through the website are completely original, unless otherwise indicated in their description. All of them have a guarantee period of two years, in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws.
APPLICABLE LAW AND JURISDICTION
These conditions will be governed or interpreted in accordance with Spanish law in what is not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these Conditions to the Courts and Tribunals of the user's domicile.
In the event that the user is domiciled outside of Spain, the provider and the user expressly waive any other forum, submitting to the Courts and Tribunals of the city of Madrid - Spain.
